What to do when you receive this document
- 1
Don't call them back yet
Calling a debt collector can restart the statute of limitations on old debt and may be used against you. Read the letter carefully and understand what you're dealing with first.
- 2
Request debt validation within 30 days
Under the FDCPA, if you send a written debt validation request within 30 days of first contact, the collector must stop collection efforts until they prove the debt is valid and the amount is correct.
- 3
Check if the debt is past the statute of limitations
Old debts (typically 3–7 years depending on state) may be past the statute of limitations. Paying or acknowledging an old debt can restart the clock. Check your state's rules before doing anything.

Does a debt collection letter mean I'll be sued?
Not necessarily. Most debt collectors send letters as the first step and prefer to settle without going to court. A lawsuit is more expensive for them too. However, if you ignore all contact, a lawsuit becomes more likely.
What is debt validation?
Debt validation is your right under the FDCPA to ask a collector to prove the debt is yours, the amount is correct, and they have the right to collect it. Send a written request via certified mail within 30 days of their first contact.
Can a debt collector contact my employer or family?
Only under very limited circumstances. Collectors can contact third parties only to locate you — they cannot discuss your debt with others. Doing so is an FDCPA violation you can sue over.
What if the debt is not mine?
Identity theft and debt mix-ups are common. If you don't recognize the debt, send a written dispute immediately. The collector must investigate and cease collection if they cannot verify the debt.
